On Rehearing. Treating the motion for rehearing as having been granted, and in view of the matters set out in the motion to delay mandate, that is, that the Soil Conservation Service is about to commence the construction of dams on the Pena Blanca and Mossman Arroyos, through which flood waters flow onto appellant's and appellees' lands, which dams will, in the future, prevent the flooding of appellant's and appellees' farm lands, the necessity for the removal of the dikes set forth in the trial court's judgment will become moot and will only cost appellant unnecessary money and labor to remove the same, the injunctive portion of the judgment is hereby stayed.
