Inez Little brought an action against Safeway Stores, Inc., to recover damages for personal injuries. At the pretrial conference it was stipulated that the issue of liability be tried separately from the issue of damages. A jury trial was had on the issue of liability, and following a verdict in favor of plaintiff the clerk was directed to withhold the entry of a judgment on the verdict until such time as the issue of damages had been determined. During the trial on the issue of damages, which was had before the same jury that found defendant liable, the court declared a mistrial because a medical witness referred to an "insurance report" in his testimony.
